I believe that accounting laws require that they sell it, that they cannot legally give it away. They can, however, do it for the phone for some reason.

It has to do with laws enacted after those problems with back-dating stock transfers or something along those lines. I think.

Since they look bad doing this, they should explain it to customers. it makes them look cheap.

Yeah I bought Itouch a couple of weeks ago and I have to pay for te upgrade as well...

So you got it for "free", and you're complaining about a $9.95 software update . If you have not yet updated the software, do it. There are more than 125 free apps for your ipod Touch available to download .
